What ‘legal basis’ will you process my personal information?

Before we go any further, by the process, we mean to look after and store. The data protection law sets out several reasons for which a company may collect and process personal information.

Contractual

We process your personal information to provide you with Surveying services. In this case, the performance of a contract is simple: You ask us to perform a valuation, which requires you to give us your address. We would be unable to provide you with this service without this information.

Legitimate interest

We will process your personal information under this condition where your privacy rights or interests do not outweigh our interest in using it. This means that we can use your personal information only in ways you would reasonably expect and which have a minimal impact on your privacy or where there is a compelling justification for the processing.

When it comes to staying in touch, we rely on legitimate interests because we only contact existing customers or people who have contacted us directly and are expecting us to do so. Each communication provides an easy-to-use opt-out.

Legal compliance

We may need to process your data to fulfil our legal obligations as a RICS-regulated business and cooperate with law enforcement, legal proceedings, or regulatory authorities.

What information do you collect?

There are several categories of data, including Identity Data, Contact Data, Financial Data, Special Category Data, and Profile and Usage Data.

We only collect the minimum personal information necessary to satisfy our contractual obligations, which includes your name, address, and basic details surrounding your property. We will collect payment details from you when you instruct us to proceed.

How will you use my personal information?

We will use your personal information to fulfil the performance of our role as a property surveyor. We will use your information to assess and identify your property in a written report (where appropriate). The information we collect about your property forms the basis of the ‘report’.

Who do we share your personal information with?

We disclose personal information to third parties, such as lenders and insurers, but only to the necessary level.

A list of the types of firms this might include is:

A lender where we are involved in your mortgage application.

A solicitor or conveyancer to help process your mortgage application or a matrimonial dispute.

An estate agent or home builder.

To fulfil our role effectively, we may need to engage the services of one of our trusted surveying partners—L&G, SDL, or Valunation. This process may require sharing relevant information with them to facilitate property surveys and valuations. In accordance with the UK General Data Protection Regulation (UK GDPR), we process this data under the legal basis of contractual necessity (Article 6(1)(b)). Our surveying partners are committed to maintaining high standards of data protection, and any information shared will be handled securely and only used for the necessary purposes.

Also, under limited circumstances, your personal information may be disclosed to third parties as permitted by, or to comply with, applicable laws and regulations. For instance, when responding to subject access requests, proceedings of a court of law or similar legal process, to protect against fraud, and to otherwise cooperate with law enforcement or regulatory authorities.

How do you collect my personal information?

Personal data is collected by us using the following methods:

Direct interactions with a surveyor or support staff in person, by post, phone, email.

Automated technologies or interactions with our website, by using the web enquiry form or the quick quote
application.

Third parties or publicly available sources, such as:

Survey instruction provider E.g. L&G Surveying Services, Estate Agents, Lenders, Financial Advisers or Solicitors with whom you may interact, but only with your consent.

How do we keep your personal information secure?

We understand how important it is to keep your personal information secure. We use a variety of technologies and procedures to protect your personal information from accidental or unlawful breaches of security. These include physical, organisational, and technological security measures.

We also limit access to your personal data to only those Finance Planning Surveying Services staff, business partners and suppliers who have a business need to know.

We have implemented procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

How long will you store my information for?

We only retain your personal data for as long as necessary. The list below outlines how long data is retained and depends on the reason the personal data is used for:

Purpose of processing Period

Survey request where we attend the property and a report is produced 21 years
Survey request that does not proceed for 2 years
A quotation request 2 years
